Ha a b\u00e9rl\u0151 nem hajland\u00f3 kik\u00f6lt\u00f6zni, nincs sz\u00fcks\u00e9g k\u00fcl\u00f6n b\u00edr\u00f3s\u00e1gi elj\u00e1r\u00e1sra, \u00e9s a v\u00e9grehajt\u00e1s k\u00f6zvetlen\u00fcl a k\u00f6zjegyz\u0151i okirat alapj\u00e1n megind\u00edthat\u00f3, mivel az v\u00e9grehajthat\u00f3 okiratnak min\u0151s\u00fcl.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt; color: #000000;\"><span style=\"text-decoration: underline;\"><strong>Az \u00f6nhatalm\u00fa ki\u00fcr\u00edt\u00e9s kock\u00e1zatot jelent<br \/>\n<\/strong><\/span>A tulajdonos nem \u00fcr\u00edtheti ki az ingatlant saj\u00e1t maga, joger\u0151s b\u00edr\u00f3s\u00e1gi hat\u00e1rozat n\u00e9lk\u00fcl. A b\u00e9rl\u0151 szem\u00e9lyes t\u00e1rgyai az ingatlanban lehetnek, \u00e9s az \u00f6nhatalm\u00fa fell\u00e9p\u00e9s s\u00e9rten\u00e9 tulajdonjog\u00e1t. Ha a b\u00e9rl\u0151 az ingatlanban lakik, a tulajdonost ak\u00e1r b\u00fcntet\u0151elj\u00e1r\u00e1s is fenyegetheti a lak\u00e1s s\u00e9rthetetlens\u00e9g\u00e9nek megs\u00e9rt\u00e9se miatt.<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt; color: #000000;\">A b\u00edr\u00f3s\u00e1gok t\u00f6bb esetben kimondt\u00e1k, hogy a tulajdonos b\u0171ncselekm\u00e9nyt k\u00f6vetett el, amikor er\u0151szakkal l\u00e9pett be saj\u00e1t tulajdon\u00fa ingatlan\u00e1ba. A v\u00e9grehajt\u00f3 gondoskodik a b\u00e9rl\u0151 tulajdon\u00e1ban l\u00e9v\u0151 t\u00e1rgyak elt\u00e1vol\u00edt\u00e1s\u00e1r\u00f3l, valamint minden szem\u00e9ly kik\u00f6lt\u00f6ztet\u00e9s\u00e9r\u0151l az ingatlanb\u00f3l.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt; color: #000000;\"><strong>K\u00e1rt\u00e9r\u00edt\u00e9s \u00e9s jogalap n\u00e9lk\u00fcli gazdagod\u00e1s<br \/>\n<\/strong><\/span><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt; color: #000000;\">Ha a b\u00e9rl\u0151 a b\u00e9rlet megsz\u0171n\u00e9s\u00e9t k\u00f6vet\u0151en haszn\u00e1lta az ingatlant, az jogalap n\u00e9lk\u00fcli gazdagod\u00e1snak min\u0151s\u00fcl (\u00a7 451 Polg\u00e1ri T\u00f6rv\u00e9nyk\u00f6nyv). A b\u00e9rbead\u00f3 b\u00edr\u00f3s\u00e1gi \u00faton k\u00f6vetelheti az enged\u00e9ly n\u00e9lk\u00fcli haszn\u00e1lat ellen\u00e9rt\u00e9k\u00e9t \u2013 ennek \u00f6sszeg\u00e9t rendszerint szak\u00e9rt\u0151i v\u00e9lem\u00e9ny \u00e1llap\u00edtja meg a helyben szok\u00e1sos b\u00e9rleti d\u00edj alapj\u00e1n.<\/span><\/p>\n<p><span style=\"font-family: arial, helvetica, sans-serif; font-size: 12pt; color: #000000;\">Amennyiben a b\u00e9rl\u0151 a meg\u00e1llapodott hat\u00e1rid\u0151ben nem \u00fcr\u00edtette ki az ingatlant, \u00e9s ezzel k\u00e1rt okozott a b\u00e9rbead\u00f3nak, a b\u00e9rbead\u00f3 jogosult k\u00e1rt\u00e9r\u00edt\u00e9st k\u00f6vetelni a b\u00edr\u00f3s\u00e1gon (\u00a7 420 Polg\u00e1ri T\u00f6rv\u00e9nyk\u00f6nyv).
